WE CONTINUE WITH THE SERIES ON DIFFERENT ASPECTS OF THE FIREARMS CONTROL ACT WHICH ARE THE MOST FREQUENTLY ASKED QUESTIONS IN THE INDUSTRY
Today we will deal with the investigation into the fitness of a person to possess a firearm in terms of section 102.
Section 102 Declaration by Registrar of person as unfit to possess firearm:
- The Registrar may declare a person unfit to possess a firearm if, on the grounds of information contained in a statement under oath or affirmation including a statement made by any person called as a witness, it appears that-
- a final protection order has been issued against such person in terms of the Domestic Violence Act, 1998 (Act 116 of 1998);
- that person has expressed the intention to kill or injure himself or herself or any other person by means of a firearm or any other dangerous weapon;
- because of that person’s mental condition, inclination to violence or dependence on any substance which has an intoxicating or narcotic effect, the possession of a firearm by that person is not in the interests of that person or of any other person;
- that person has failed to take the prescribed steps for the safekeeping of any firearm; or
- that person has provided information required in terms of this Act which is false or
- A declaration under subsection (1) may only be issued if the Registrar-
- by notice in writing delivered by hand to the person, has called upon the person to appear before the Registrar at a time and place determined therein in order to advance reasons as to why that person should not be declared unfit to possess a firearm;
- has given that person a reasonable opportunity to advance reasons as to why the declaration should not be issued;
- has duly considered the matter;
- is satisfied that the person is unfit as contemplated in subsection (1); and
- does not rely solely on the same facts relating to a conviction in respect of which a court has made a determination in terms of section 103 (1) or (2) that the person is not unfit to possess a firearm.
- Any person appearing in pursuance of a notice issued in terms of subsection (2) (a) is entitled to-
- be represented by a legal representative;
- request the Registrar to call, in the manner referred to in subsection (2) (a), any person who made a statement referred to in subsection (1), to appear before the Registrar; and
- examine the person who has been called in terms of subsection (1) or paragraph (b) to appear, or to cause him or her to be so examined by such legal representative.
- (a) Section 183 of the Criminal Procedure Act, 1977 (Act 51 of 1977), applies with the necessary changes to any person called to appear before the Registrar in terms of subsection (2) (a), including any witness.
- For purposes of paragraph (a) the expression ‘to a fine not exceeding R300 or to imprisonment for a period not exceeding three months’ where it occurs in section 183 (2) of the Criminal Procedure Act, 1977 (Act 51 of 1977), must be construed to read as follows: ‘to a fine or to imprisonment for a period not exceeding 12 months’.
- Section 181 of the Criminal Procedure Act, 1977 (Act 51 of 1977), applies with the necessary changes in respect of any witness whose appearance has been requested as contemplated in subsection (3) (b).

ONS DOEN TANS ‘N REEKS OOR DIE VERSKILLENDE ASPEKTE VAN DIE WET OP DIE BEHEER VAN VUURWAPENS WAT GEREELD VRAE ONTLOK IN DIE INDUSTRIE.
Vandag deel ons met artikel 102 wat behels die ondersoek na die bevoegdheid van ʼn persoon om ʼn vuurwapen te besit op grond van ʼn verklaring onder eed of bevestiging ontvang.
Artikel 102 Verklaring deur Registrateur van persoon as onbevoeg om vuurwapen te besit:
- Die Registrateur kan ‘n persoon onbevoeg verklaar om ‘n vuurwapen te besit indien, op grond van inligting vervat in ‘n verklaring onder eed of bevestiging met inbegrip van ‘n verklaring gedoen deur enige persoon wat as getuie geroep is, dit blyk dat-
- ‘n finale beskermingsbevel teen sodanige persoon ingevolge die Wet op Gesinsgeweld, 1998 (Wet 116 van 1998), uitgereik is;
- daardie persoon die voorneme uitgespreek het om hom of haarself of enige ander persoon te dood of te beseer deur middel van ‘n vuurwapen of enige ander gevaarlike wapen;
- as gevolg van daardie persoon se geestelike toestand, neiging tot geweld of afhanklikheid van enige stof wat ‘n bedwelmende of narkotiese uitwerking het, die besit van ‘n vuurwapen deur daardie persoon nie in die belang van daardie persoon of enige ander persoon is nie;
- daardie persoon versuim om die voorgeskrewe stappe te doen vir die veilige bewaring van enige vuurwapen; of,
- daardie persoon inligting vereis ingevolge hierdie Wet verskaf het wat vals of misleidend
- ‘n Verklaring kragtens subartikel (1) kan slegs uitgereik word indien die Registrateur-
- by skriftelike kennisgewing per hand gelewer aan die persoon, die persoon opgeroep het om voor die Registrateur te verskyn op ‘n tyd en plek daarin bepaal ten einde redes aan te voer waarom daardie persoon nie onbevoeg verklaar moet word om ‘n vuurwapen te besit nie;
- daardie persoon ‘n redelike geleentheid gebied het om redes aan te voer waarom die verklaring nie uitgereik behoort te word nie;
- die aangeleentheid behoorlik oorweeg het;
- oortuig is dat die persoon onbevoeg is soos beoog in subartikel (1); en
- nie alleen staatmaak op dieselfde feite met betrekking tot ‘n skuldigbevinding ten opsigte waarvan ‘n hof ‘n vasstelling ingevolge artikel 103(1) of (2) gedoen het dat die persoon nie onbevoeg is om ‘n vuurwapen te besit
- Enige persoon wat ter nakoming van ‘n kennisgewing uitgereik ingevolge subartikel (2) (a) verskyn, is geregtig om-
- verteenwoordig te word deur ‘n regsverteenwoordiger;
- die Registrateur te versoek om, op die wyse bedoel in subartikel (2) (a), enige persoon wat ‘n verklaring bedoel in subartikel (1) gedoen het, te roep om te verskyn voor die Registrateur; en
- die persoon te ondervra wat ingevolge subartikel (1) of paragraaf (b) opgeroep is om te verskyn of teweeg te bring dat hy of sy aldus ondervra word deur sodanige
- (a) Artikel 183 van die Strafproseswet, 1977 (Wet 51 van 1977), is met die nodige veranderings van toepassing op enige persoon wat opgeroep is om voor die Registrateur te verskyn ingevolge subartikel (2)(a), met inbegrip van enige getuie.
- By die toepassing van paragraaf (a) moet die uitdrukking “met ‘n boete van hoogstens R300 of met gevangenisstraf vir ‘n tydperk van hoogstens drie maande” waar dit voorkom in artikel 183 (2) van die Strafproseswet, 1977 (Wet 51 van 1977), uitgelê word om as volg te lui: “met ‘n boete of met gevangenisstraf vir ‘n tydperk van hoogstens 12 maande”.
- Artikel 181 van die Strafproseswet, 1977 (Wet 51 van 1977), is van toepassing met die nodige veranderings ten op van enige getuie wie se verskyning versoek is soos beoog in subartikel (3)(b).
