WE CONTINUE WITH THE SERIES ON DIFFERENT ASPECTS OF THE FIREARMS CONTROL ACT WICH ARE THE MOST FREQUENTLY ASKED QUESTIONS IN THE INDUSTRY
Today we will deal with the effect of the declaration of unfitness and the proof of this declaration in terms of section 104 and 105 of the Act.
Section 104 – Effect of declaration
- (a) All competency certificates, licenses, authorisations, and permits issued in terms of this Act to any person who becomes or is declared unfit to possess a firearm in terms of section 102 or 103, cease to be valid from the date of the conviction, or the declaration, as the case may be.
(b) Despite the noting of an appeal against the decision of a court or of the Registrar, the status of unfitness contemplated in paragraph (a) remains in effect pending the finalisation of the appeal.
- A person who becomes or is declared unfit to possess a firearm in terms of section 102 or 103 must within 24 hours surrender to the nearest police station-
- all competency certificates, licenses, authorisations and permits issued to him or her in terms of this Act;
- all firearms in his or her possession; and
- all ammunition in his or her
- (a) A person who has surrendered his or her firearm as contemplated in subsection (2) must dispose of the firearm and ammunition through a dealer or in such manner as the Registrar may determine-
- if an appeal is lodged and that appeal is unsuccessful, within 60 days of the finalisation of the appeal; or
- If no appeal is lodged, within 60 days of the receipt of a written notice from the Registrar informing the person of his or her unfitness to possess a firearm.
- If the firearm and ammunition are not disposed of within 60 days, they must be forfeited to the State and destroyed or disposed of as
- The period of 60 days referred to in this subsection may be extended by the Registrar on good cause shown.
- For purposes of subsection (3) (a), the Registrar must release the firearm and ammunition in question to a dealer identified by the relevant person, for disposal by that dealer on behalf of the
- (a) The holder of an additional license referred to in section 12 (1) may, if the holder of the license becomes or is declared unfit to possess a firearm, apply to the Registrar for the issue of a new license in his or her name.
(b) If the holder of an additional license does not make an application referred to in paragraph
(a) within 30 days of the-
- date on which the time for an appeal elapses; or
- finalisation of the appeal if it does not affect the status of unfitness, the additional firearm license
- If the decision leading to the status of unfitness to possess a firearm of any person is set aside, any seized or surrendered firearm, ammunition, license, permit, or authorisation belonging to any such person, must be
- Subject to section 9 (3) (b) and after a period of five years calculated from the date of the decision leading to the status of unfitness to possess a firearm, the person who has become or been declared unfit to possess a firearm may apply for a new competency certificate, license, authorisation or permit in accordance with the provisions of this
Section 105 – Proof of declaration
A certificate purporting to have been signed by the Registrar or by the registrar of a High Court, the clerk of a magistrates’ court or the clerk of a military court, stating that the person mentioned in the certificate has become or been declared unfit to possess a firearm, or has been convicted of a specific offence or crime, is upon production thereof by any person, prima facie evidence of the facts stated in that certificate.

ONS DOEN TANS ‘N REEKS OOR DIE VERSKILLENDE ASPEKTE VAN DIE WET OP DIE BEHEER VAN VUURWAPENS WAT GEREELD VRAE ONTLOK IN DIE INDUSTRIE.
Vandag deel ons met artikel 104 wat behels die uitwerking van `n verklaring van onbevoegdheid en artikel 105 wat behels die bewys van so `n verklaring.
Artikel 104 – Uitwerking van verklaring van onbevoegdheid
- (a) Alle bevoegdheidsertifikate, lisensies, magtigings en permitte uitgereik ingevolge hierdie Wet aan enige persoon wat ingevolge artikels 102 of 103 onbevoeg raak of verklaar word om ‘n vuurwapen te besit, hou vanaf die datum van die skuldigbevinding, of die verklaring, na gelang van die geval, op om geldig te
(b) Ondanks die aantekening van appèl teen die beslissing van ‘n hof of die Registrateur, is die status van onbevoegdheid beoog in paragraaf (a) van krag hangende die finalisering van die appèl.
- ‘n Persoon wat ingevolge artikel 102 of 103 onbevoeg raak of verklaar word om ‘n vuurwapen te besit, moet, binne 24 uur- (a) alle bevoegdheidsertifikate, lisensies, magtigings en permitte uitgereik aan hom of haar ingevolge hierdie Wet; (b) alle vuurwapens in sy of haar besit; en (c) alle ammunisie in sy of haar besit, by die naaste polisiekantoor afgee.
- (a) ‘n Persoon wat sy of haar vuurwapen oorhandig het soos beoog in subartikel (2), moet oor die vuurwapen of ammunisie beskik deur middel van ‘n handelaar of op die wyse wat die Registrateur bepaal- (i) indien ‘n appèl ingedien word en daardie appèl onsuksesvol is, binne 60 dae van die finalisering van die appèl; of (ii) indien geen appèl ingedien word nie, binne 60 dae van die ontvangs van ‘n skriftelike kennisgewing van die Registrateur wat die persoon in kennis stel van sy of haar onbevoegdheid om ‘n vuurwapen te
- Indien nie binne 60 dae oor die vuurwapen en ammunisie beskik word nie, moet dit verbeur word aan die Staat en vernietig word of oor beskik word soos
- Die tydperk van 60 dae bedoel in hierdie subartikel kan by die aanvoer van gegronde redes deur die Registrateur verleng
- By die toepassing van subartikel (3) (a) moet die Registrateur die betrokke vuurwapen en ammunisie vrystel aan die handelaar geïdentifiseer deur die toepaslike persoon, vir beskikking deur daardie handelaar namens die
- (a) Die houer van ‘n addisionele lisensie bedoel in artikel 12(1) kan, indien die lisensiehouer onbevoeg raak of verklaar word om ‘n vuurwapen te besit, by die Registrateur aansoek doen om die uitreiking van ‘n nuwe lisensie in sy of haar
(b) Indien die houer van ‘n addisionele lisensie nie binne 30 dae van- (i) die datum waarop die tyd vir ‘n appèl verstryk; of (ii) die finalisering van die appèl wat nie ‘n uitwerking het op die status van onbevoegdheid nie, ‘n aansoek bedoel in paragraaf (a) doen nie, verval die addisionele vuurwapenlisensie.
- Indien die besluit wat lei tot die status van onbevoegdheid om ‘n vuurwapen te besit van enige persoon tersyde gestel word, moet enige vuurwapen, ammunisie, lisensie, permit of magtiging wat aan enige sodanige persoon behoort en waarop beslag gelê is of wat oorhandig is, teruggelewer
- Behoudens artikel 9 (3) (c) en na ‘n tydperk van vyf jaar van die datum van die besluit wat lei tot die status van onbevoegdheid om ‘n vuurwapen te besit, kan die persoon wat onbevoeg raak of verklaar is om ‘n vuurwapen te besit, aansoek doen om ‘n nuwe bevoegdheidsertifikaat, lisensie, magtiging of permit ooreenkomstig die bepalings van hierdie
Artikel 105 – Bewys van verklaring
‘n Sertifikaat wat heet geteken te wees deur die Registrateur of deur die registrateur van ‘n hoë hof, die klerk van ‘n landdroshof of die klerk van ‘n militêre hof, wat verklaar dat ‘n persoon vermeld in die sertifikaat onbevoeg raak of verklaar is om ‘n vuurwapen te besit, of skuldig bevind is aan ‘n spesifieke misdryf of misdaad, is by voorlegging daarvan prima facie- bewys van die handelinge vermeld in daardie sertifikaat.
