REVISED TOPS REGULATIONS REPUBLISHED FOR PUBLIC COMMENT

12 October 2023 – The Department of Forestry, Fisheries, and the Environment (DFFE) published the National Environmental Management: Biodiversity Act (10 of 2004) Republication of the Draft Regulations Pertaining to Listed Threatened or Protected Terrestrial Species and Freshwater Species for public Comment in the Government Gazette to address shortcomings identified in the previous draft.

This follows a successful joint litigation by WRSA and PHASA to have the first publication on 03 February 2023, that was set to come into effect on 01 April 2023, withdrawn. The reason that the litigation was brought to the Gauteng High Court in March of 2023, was that, according to WRSA CEO, Richard York, that the Department has “shut the door on industry during discussions held on 27 February 2023″ where a strong contingent of WRSA representatives raised serious concerns regarding the implications the regulations would have on the wildlife industry.
