
Two significant legislative changes have recently been enacted that may have far-reaching implications for wildlife ranchers and the broader agricultural sector. Below is a brief summary of the Expropriation Act, 2024 and the Preservation and Development of Agricultural Land Act, 2024, both of which were recently signed into law by the President.
1. Expropriation Act, 2024 (Act No. 13 of 2024)
This Act sets out the legal framework for the expropriation of property by the government for public purposes or in the public interest. Key provisions include:
• Compensation must be just and equitable, considering factors like market value, current use, and historical acquisition.
• In some cases, nil compensation may be justified for land that is abandoned, state-subsidized, or not being optimally used.
• The government must attempt to reach an agreement with the property owner before initiating expropriation.
This Act replaces the Expropriation Act of 1975 and aligns with Section 25 of the Constitution, which emphasizes land reform and equitable access to resources.
2. Preservation and Development of Agricultural Land Act, 2024 (Act No. 39 of 2024)
This Act aims to protect high-value agricultural land and ensure sustainable farming practices. Important aspects include:
• It applies to all agricultural land and prevents fragmentation and non-agricultural land use.
• Provincial agricultural sector plans will be developed to guide land use and management.
• Certain areas may be declared protected agricultural areas, restricting their use for non-agricultural activities.
• New regulations will govern agro-ecosystem management, ensuring responsible land use and conservation.
WRSA is currently analyzing the full implications of these laws and will provide further guidance to members. WRSA is also collaborating with several organisations to ensure that wildlife ranchers’ right to private ownership and doing business is maintained.
